Big Day For HIPAA/HITECH Provisions

 FEBRUARY 18TH BIG DAY FOR HIPAA/HITECH PROVISIONS  

While many of the changes to HIPAA contained in the HITECH amendment, such as increased fines, Attorney’s General enforcement, and Health Data Breach notification came into effect already, February 18th, the law’s one year anniversary, marks a number of significant HIPAA/HITECH milestones.   Here is a sample of some that could affect the secure destruction service provider . . .   Application of rules to, and accountability for, Business Associates.  (No longer are BAs solely tied to HIPAA by the BA contract with the Covered Entity, but now, in some respects, operate essentially with all the requirements applied to Covered Entities.) Requirement for HHS to begin conducting mandatory audits. Clarification regarding which entities are required to be business associates. (Both HHS and the FTC have already identified secure destruction services as BAs in earlier guidance publications.  It would difficult to see this changing) HHS and FTC study on privacy and security requirements for PHR vendors and applications (PHR vendors are a new type of Covered Entity under FTC jurisdiction who maintain or process health-related data as a result of offering Internet based services.) First annual guidance on the most effective and appropriate technical safeguards for health information. (This could go either way.  When HHS issued guidance on security measures to avoid data breach, they inadvertently caused many Covered Entities to apply the wrong particle size specification.  If guidance is promulgated in this new document with a similar type of reference, it will  make life a bit more complicated for secure destruction services) HHS to implement a health information privacy educational initiative Clarification regarding the ability to impose criminal penalties against individuals.

This year’s theme — Dollars & Sense: Rated “A” for All Ages — highlights the importance of using good consumer sense at every stage of life - from grade school to retirement.  In recognition of NCPW 2010, Shred 360 and its partners are promoting free information destruction to help people protect their privacy and avoid identity theft.

“The message of National Consumer Protection Week 2010 is simple: It’s never too early or too late to become a more informed and empowered consumer. “Regardless of your age or financial situation, there are useful lessons to learn about spending and managing money wisely.  Shred 360 encourages everyone to visit the NCPW and Shred 360 websites, www.consumer.gov/ncpw, www.shred360.com, for tips about making smarter decisions in the marketplace. ”

            This year, NCPW organizations are reaching out to kids, focusing on websites, videos and games designed for a younger audience.  Kids under 12 spend billions of dollars on goods and services each year, so it makes sense to provide them with these valuable tools.  It’s essential that kids understand key consumer and business concepts, like credit and identity theft, banking and fraud, and marketing and advertising.  The resources highlighted on the NCPW website introduce these concepts and teach kids practical lessons about the role of business and government in their everyday lives.      

In addition, for the first time, the NCPW website features a blog, where visitors can discover new consumer resources in an informal and interactive environment.  Here, visitors have the opportunity to connect directly with representatives of public and private consumer protection organizations.

Now That’s a Fine!

Good day to all Shred 360 fans!  Shred 360 would like to take this opportunity to bring your office up to speed on some changing rules pertaining to your secure documents. 

Senator Leahy (D-VT) and Senator Schumer (D-NY) have introduced new initiatives to dramatically increase the potential consequences to organizations that improperly discard sensitive information, as quoted by Bob Johnson the executive Director of NAID in the Shredder Industry Report, Fall 2009.

Also, we would like to inform you on some changes relating to HIPAA. This act was developed to protect Patient Health Information (PHI).  The State’s Attorney Generals office will now be enforcing this act. The fines were 25K per incident and have now been increased up to 1.5M per incident. These fines are mandatory if the incident is found to have been willful neglect. This act also requires written policies to be in place at your office.

The safeguard of proprietary information can not and should not be taken likely.  Please do your part to make sure your office is compliant with the rules.

The Shredding Truth - Wrong, Wrong, Wrong:

On November 1st, being pushed back twice, the Red Flag Rule (amendment to FACTA) will finally go into effect, requiring every organization “that holds any consumer account, or other account for which there is a reasonably foreseeable risk of identity theft” to develop what it calls “reasonable policies and procedures for detecting, preventing, and mitigating identity theft.”  The FTC says that the law will apply to an estimated 11 million organizations.

A False Sense of Security

Do you assume that because you have contracted with an outside vendor for document shredding services that your program is automatically secure and meets all of your organization’s security requirements?  Don’t feel bad, most people do.

Many organizations that use a shredding provider fall into a routine that is more secure than in-house shredding, but really does not meet the minimum security requirements that these same organizations require of them.  Here are some examples:

  •  The lock is removed from a roll cart to make it easier to lift the lid and dump large quantities of material into the cart.
  •  The shredding vendor does not allow clips, binders, etc. to be shredded and therefore many employees look at a binder or box of sensitive information and simply do not have the time, patience, or motivation to separate the material - so they throw it in the trash.
  • The key for the shred container is left in the lock so that employees might easily access material that was mistakenly put in the container.
  • Shred containers are in central storage areas and not easily accessible for all employees, so many employees keep a small cardboard box under their desk for confidential information and then dump it when “the shred guy is here.”
  • Employees find it easier to leave a couple of boxes on top of the shred container marked “shred” instead of taking the time to put the material into the container or keep it locked away in an office until the shredding provider is on site.

All of these scenarios open the door for confidential information to fall into the wrong hands or be exposed to individuals that do not have access or clearance.  Lawsuits, decreased employee morale, poor customer perception, or large fines imposed by governmental agencies are all plausible outcomes of these types of situations.

The solution?  Develop a written plan or guideline that identifies your document security requirements as they relate to internal goals and external/legal requirements (a few short sentences will suffice).  Communicate these requirements to employees and vendors.  Make sure that you are using a shredding provider that values your specific security requirements and takes steps to ensure that they are being met.  You should expect to receive at least two phone calls per year from your provider that are strictly security-focused and provide notification of the above-mentioned examples and offer solutions to further enhance the security of your program.

Identity Theft Tip: Social Networking…Stay Safe

Who hasn’t heard of the basic tips on how to protect your identity?  Shield your PIN from on-lookers when using the key pad, keep your Social Security card at home, etc.  Those are great things to remember.

Well, there is an emerging and powerful tool that can be used in many great ways, but also can be a new way for identity thieves to gather information against you…social networking.  If you show your face on Facebook or you become Linked In-to your business and other social contacts, be careful.  Pages that you create, though deleted later, can be eternally archived in the electronic world.  As always, do not post information that can be gathered to be used to take your identity.  Use the same caution with your confidential information and do not let your guard down just because it is a “social” setting.  Thieves prey on people who have their guard down.

The $1,200 Weed

I know of a landscaping company that just recently lost a client and the catalyst was a weed growing among “sticker bushes,” as the crew chief stated.  The client was a commercial account that paid $1,200 per month for their lawn maintenance.  That was a nice account.  Granted, with the economy downturn, the lawn maintenance could have purely been a cost that needed to be cut (pun intended).  However, the weed was a repeated discussion with the client and a sore spot with her that it was not managed.

Examine your business, especially in these times of uncertainty.  It is paramount that not only do you have to aggressively go after sales, but you have to be diligent in listening to your existing clients.  I am purely speculating, but what if the person had received better than expected lawn maintenance service and there was no room for complaint.  Would it have made a difference when they were discussing what could be cut out?  We’ll never know.  You can’t afford to allow weeds to grow in your relationship with your clients.  Not now.

What Should You Do

I recommend calling or taking your top ten best clients to lunch.  Host a gathering for your top 25 clients.  Do something to make contact.  At the very least, they should hear from you monthly.  Don’t let your competition call them more often.  You need to know if there is a weed growing that could potentially cause you to lose their business.  It is a delicate, but important, balance to maintain the clients you do have while pursuing new business.  Set a goal that you will set a face-to-face meeting or phone appointment with your ten best clients before the end of the week.

Nascar Nationwide Series Driver Danny Efland of Irmo, S.C. will drive the Shred 360 Chevy at the, “The Beast of the South”, The Charlotte Motor Speedway on Friday, October 10, 2008 (7:30PM).  It is a fantastic opportunity for both Danny Efland and Shred 360 to team up.  The racing event is in both of our back yards, and good number of local fans, support, and customers will get to enjoy the event.

So…The Economy is Down

I know, I know.  Even the shredding guy is talking about the economy.  It is definitely on the minds of business owners and employees alike.  I am writing this article to encourage those of you who read it.  For those of you who don’t want to be encouraged, you can stop reading here and I won’t be offended.

So what do we do about it?  That is a tough question.  Albert Einstein once said, “it’s not that I am so smart; it’s just that I stay with problems longer.”  It would be safe to say that someone could blame their business failure on the economy and no one would point a finger at them in blame.  Truly, there are circumstances that are beyond our control at work here.  However, I am only going to talk about the possibility that the answer to your current declining sales, lack of liquidity, increasing overhead and gas prices are right in front of you…but you have to look for it.  I submit to you that the most successful businesses have had to adapt to tough times by being creative to experience longevity.  I was an English major in college and never took an economics class, so forgive me if my terms aren’t correct, but I want to make a point.  Recently, there was discovered a Van Gogh painting (http://www.livescience.com/history/080730-van-gogh.html) that had a painted image beneath the one you could see with the naked eye.  He was known for doing that as much as for every one in three paintings.  There is a new technique called synchrotron radiation induced X-ray fluorescence spectroscopy that allows them to see the painting beneath the famous Patch of Grass work.  Until now, the image was impossible to see with the naked eye.  New tool, new market.

In principal, technology defines what creates a need.  I’m sure the scientists will have people lined up for wanting to know what’s behind their Van Gogh.  As it relates to you, if you had a new tool, concept, process or product that opened up a “hidden market,” you would be better positioned to sustain a tough economy and be poised to thrive when (eventually) things do turn around. 

Though there are a lot of things you can’t control, spend some time “X-raying” your business.  Re-think your sales and marketing plan.  Re-tool your product line.  Re-examine your services.  You just might find your hidden treasure.

“But I don’t need a document security program.”   I would like to address a common objection we hear as it relates to not having a document security program:  “We don’t need a service.”  I thought of this when I read the human interest story in Tokyo about a lost parrot that told a veterinarian his name and home address, consequently equipping the vet with all they needed to reunite Mr. Yosuke Nakamura (parrot) with his owner.   

The parrot owner said that they have been teaching the parrot his address for two years.  It could be argued that teaching the parrot this information was unnecessary and possibly a waste of time…until he was lost.  Though he did not talk to the police, which is funny in and of itself, he did spill the beans with the vet.

 For some low volume businesses, a document security program can be put in place for as little as $248 per year.  Some people see that as a potential waste of money, and that could be a valid argument…until some information was lost and misused.  So, just like the owner teaching the parrot his address, you could be wasting your time with a document security program, but in reality, it is time and money well spent.

WACH Fox, Palmetto Citizens & AARP Hold Summer Shred-a-Thon

1.800.922.1594 (toll free in SC)Email: scdca@dca.state.sc.us  FOR IMMEDIATE RELEASE:  IDENTITY THEFT BILL PROVIDES MORE PROTECTION FOR CONSUMERS Columbia, SC…..South Carolina consumers can do more to protect their identity now that the General Assembly passed and Governor Mark Sanford signed the “Financial Identity Fraud and Identity Theft Protection Act” on April 2, 2008. The Act provides much needed protection for consumers and is one of the most consumer-friendly and comprehensive bills of its kind in the nation. A primary provision in the bill allows consumers to freeze and thaw their credit report at no charge. Any consumer may place a freeze on their report, including those wanting to take proactive measures to protect themselves against identity thieves or not wanting to receive more credit than they can financially handle. Businesses, however, have no need to worry about consumers not being able to make purchases as they choose. Thawing your credit only takes one phone call and 15 minutes. South Carolina is one of only two states in the country that provides this service to consumers free of charge. The Act also provides requirements in the area of credit report disputes that are similar to those in the Federal Fair Credit Reporting Act. Under the Financial Identity Fraud and Identity Theft Protection Act, credit reporting agencies must follow certain procedures when a consumer notifies it of an inaccurate or untimely item on their credit report. The consumer is also given the right to sue a credit reporting agency if it does not comply with the Act. This portion of the act will be effective December 31, 2008.  In addition to giving consumers more control with their credit, the bill also addresses identity theft concerns. According to the Act, organizations and businesses who maintain consumers’ personal information must now alert consumers when their personal information may have been compromised. Notice of the security breach must also be given to the Department if 1000 more South Carolina consumers were affected. The Department has been given the responsibility of ensuring consumer are being informed when their identity has been compromised internally or externally. This portion of the bill will be effective July 1, 2009. The bill also requires all organizations and businesses collecting personal information to have measures for the safe disposal of material “in a manner that makes it unreadable or undecipherable.” The Department has been tasked to ensure this requirement is satisfied. This portion of the bill will also be effective July 1, 2009. 

Other provisions of the Act include making identity theft a crime, prohibiting dumpster diving, putting restrictions on the use of social security numbers, and limiting the information on credit card receipts. What Does a Thief Look Like?

I recently attended a conference for the Institute of Management Accountants (IMA) in Myrtle Beach.  The first speaker had everyone captivated.  His name is Walt Pavlo, a former MCI Senior Manager.  He was responsible for the billing and collection of nearly $1 billion in monthly revenue for MCI’s carrier finance division.  He has the typical “executive” look.  He is well-spoken, polished, and could be anyone’s next door neighbor or best friend.  Walt told his story about how he slowly began misappropriating funds and not accurately entering some ledger entries in the interest of trying to help out the long-distance re-seller keep their business up so they could pay MCI what they owed.  In the beginning it was to help his department collect bad debt, at the encouragement of the “higher-ups” to cover it up.  Over time, things got worse.  Eventually, he and two others scammed a few of MCI’s customers out of $6 million and he spent two years in prison.

He asked one thing that made me think of our industry.  Walt asked the audience if he looked like a thief.  The obvious answers were either “no” or “I can’t tell just by looking at you.”  The reason our industry exists is because you can’t tell who will take and misuse your sensitive information just by looking at them.

Now don’t go printing this article and target innocent people in your office and start firing people who look like a thief (in your opinion).  Seriously, Walt said that one safeguard that a company should implement and promote is an ethics policy.  Environments with aggressive corporate behavior and that are void of ethical standards allow things to go unchecked.  Ask yourself, what, if any, ethical policies have you implemented and promoted to your employees?  It does make a difference.

I’m sure we have all heard someone say that they would trade their health for someone else’s.  How would you like to trade your “medical” identity with someone else.  Far fetched?  Thieves are using the identity of others to get medical care.  It creates a mess of paperwork and could cause a life-threatening situation if the thief’s medical condition gets mixed in with your records.  A woman named Anndorie Sachs almost had her children removed by child protective services because a methamphetamine user used one of her children’s identity to obtain medical care.  Read the full story here.

Temp Agency Permanently In Trouble

 Mega Force Employment agency made a mega-mistake.  The company’s client file records, as many as a thousand, were found in a dumpster this week in Florence, SC.  “Temp” agency files typically contain very sensitive information:  social security numbers, banking information and sometimes health information.  At this time, there are no SC laws that have been broken, but the Department of Consumer Affairs has been working on the ID Theft Bill, which will include fines for misuse of consumer information.  The Federal Trade Commission is the governing body that addresses the issue as it relates to the Disposal Rule (http://www.ftc.gov/opa/2005/06/disposal.shtm) in the Fair and Accurate Credit Transactions Act (FACTA).   The FTC has just started to hand out penalties to companies who misuse consumer information.  Recently, a mortgage company in Illinois was fined $50,000 for illegally dumping client records.

“Red Flag” Rules - FACTA Mandatory Compliance 11/01/08

If you have a creditor relationship with your customers, you need to find out about the ”red flag” rules and how it affects you. 

Have you completed an audit of your information security program?  Is your plan written? Do you know what the 26 red flags are?  If you answered no to at least one of the preceding questions, you should read further.  FACTA has new amendments that all affected employers MUST comply with by November 1st, 2008.  The Federal Trade Commission (FTC) is the overseeing body of enforcement and has identified 26 red flags that employers must audit regarding their client information. HIPAA and CIP programs are good, but they don’t take the place of a Red Flag Program.
